Terms of Service

Agreement to Terms

By accessing or using AlderWeb's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

AlderWeb provides website design and development services for small businesses, including but not limited to:

  • One-page websites
  • Landing pages
  • Portfolio websites
  • Event websites
  • Temporary and coming soon pages
  • Small e-commerce integration

Pricing and Payment

Service Fee

Our standard service fee is $250, which includes:

  • Website design and development
  • Fast hosting
  • SSL security certificate
  • Mobile optimization
  • Content updates as needed

Payment Terms

  • Payment is required before the website goes live
  • Annual renewals are due on the anniversary of your go-live date
  • We accept payment via credit card, debit card, or e-transfer

Delivery Timeline

We aim to deliver your website within 1-3 business days after receiving all necessary materials and information. Complex projects may require additional time, which will be communicated during the proposal stage.

Revision and Approval Process

  • You will receive a preview of your website before payment
  • Reasonable revisions are included in the service fee
  • Major scope changes may require additional fees
  • Final approval must be provided before the site goes live

Content and Materials

Client Responsibilities

You are responsible for providing:

  • Text content, images, and other materials
  • Necessary business information and branding assets
  • Timely feedback and approvals

Content Rights

  • You retain ownership of all content you provide
  • You grant us license to use your content to build and host your website
  • You warrant that you have rights to all materials provided

Hosting and Maintenance

  • Website hosting is included in the annual fee
  • We handle technical maintenance, updates, and security
  • Content updates are included (reasonable scope)
  • We guarantee 99% uptime (excluding scheduled maintenance)

Cancellation and Refunds

Before Go-Live

If you decide not to proceed before payment and go-live, there is no charge. You simply walk away.

After Go-Live

  • You may cancel at any time by providing 30 days notice
  • No refunds for partial years
  • Upon cancellation, we will provide you with a copy of your website files

Intellectual Property

  • Upon full payment, you own the content and specific design of your website
  • We retain ownership of our underlying code, templates, and proprietary systems
  • We may showcase your website in our portfolio unless you request otherwise

Limitation of Liability

AlderWeb is not liable for:

  • Lost profits or business opportunities
  • Indirect, incidental, or consequential damages
  • Third-party service failures (payment processors, external APIs)
  • Content you provide that infringes on third-party rights

Our total liability is limited to the amount you paid for services in the past 12 months.

Prohibited Uses

You may not use our services for:

  • Illegal activities
  • Spam or phishing
  • Malware distribution
  • Adult content
  • Hate speech or discriminatory content

Termination

We reserve the right to terminate service immediately if you:

  • Violate these terms
  • Fail to pay renewal fees within 30 days of due date
  • Use the service for prohibited purposes

Changes to Terms

We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Hamilton, Ontario.
